Why 1099s trip sellers up

The rules changed for 2026 payments.

January is the wrong time to find out who you paid, how, and whether you have their tax ID.

01

$2,000 is the new line

For payments made after December 31, 2025, the 1099-NEC threshold is $2,000 a year per non-employee, up from $600. The IRS says it may be adjusted for inflation from 2027.

02

A W-9 before the first payment

Form W-9 is how a payee gives you the correct taxpayer ID for the information return. Asking in January is how forms end up late.

See accounts payable →
03

Card payments go on a different form

Payments made by credit card or through a third-party network are reported on Form 1099-K, not on a 1099-NEC or 1099-MISC.

Contractor or employee?

The IRS looks at behavioral control, financial control and the type of relationship. Workers you direct like staff may belong on payroll.

Questions

1099 filing questions

What is the 1099-NEC threshold for 2026?

For payments made after December 31, 2025, you file a 1099-NEC for each non-employee you pay $2,000 or more for services in the year. It was $600 for earlier payments, and the IRS says it may be adjusted for inflation beginning in 2027.

When are 1099s due?

File the 1099-NEC with the IRS and give the contractor their copy by January 31. A 1099-MISC goes to the recipient by January 31 and to the IRS by February 28 on paper or March 31 electronically. A date that falls on a weekend or legal holiday moves to the next business day, so for 2026 payments the 1099-NEC is due February 1, 2027.

Do I send a 1099 to a contractor I paid by credit card?

No 1099-NEC is needed for that payment. Payments made by credit card or through a third-party network are reported on Form 1099-K instead.

Do corporations get a 1099?

Generally, payments to a corporation, including an LLC taxed as a C or S corporation, don't need a 1099-MISC. Payments for legal services are an exception, and we check every payee's W-9 for its tax classification.

Do my 1099s have to be filed electronically?

Yes, if you file 10 or more information returns in total for the year. The IRS's free IRIS system accepts 1099-NEC and 1099-MISC and needs an IRIS Transmitter Control Code. Your payroll or 1099 provider submits the forms; we prepare and check them first.

How much does 1099 filing cost?

$25 per form, from our pricing page, confirmed in writing after your free books review.
